About These Terms
These terms and conditions govern your use of the Silk Lab website at silklab.co.za and apply when you make an enquiry, request a quotation, or engage Silk Lab for any service. By using this website or contacting Silk Lab, you agree to these terms.
Silk Lab is a web development studio based in Cape Town, South Africa.
Services
Silk Lab provides custom web design and development services including brochure websites, e-commerce stores, web applications, brand identity, SEO setup, professional email configuration, and monthly maintenance retainers.
All services are subject to a written proposal and agreement before work commences. A quotation is not a guarantee of availability or a confirmation of work.
Quotations and Pricing
Quotations are valid for 14 days from the date of issue unless otherwise stated. Silk Lab reserves the right to withdraw or revise a quotation at any time before it is accepted.
All prices are quoted in South African Rand.
Quoted prices cover design and development only. The following costs are separate and are the client's responsibility:
- Domain registration from year two onward
- Hosting costs beyond the free tier of the client's chosen provider
- Payment gateway fees and subscriptions
- Email platform fees beyond the free tier
- Any third-party API or service subscriptions required by the project
Where Silk Lab includes domain registration for the first year as part of a service, this will be explicitly stated in the proposal.
Payments
A non-refundable deposit of 50% is required before any project work begins. The remaining 50% balance is due on completion before the project goes live.
For once-off services valued under R2,000, full payment is required upfront before work commences.
Invoices are payable within 5 business days of issue.
Cancellations and Refunds
Project cancellations
If a client cancels a project after paying the deposit, the deposit is non-refundable. No further amounts are due from the client regardless of the stage of completion.
Once-off services
Fees paid for once-off services are non-refundable once work has commenced.
Silk Lab cancellations
If Silk Lab is unable to complete a project or service, any amounts paid will be refunded to the client in full minus the value of work already delivered.
Cancellations must be communicated in writing to info@silklab.co.za.
Timelines and Delivery
Quoted build timelines begin from the date all required content is received from the client, not from the date of deposit.
Silk Lab will communicate a target start date at the time of deposit. If content is not received by that date, the project slot may be reassigned. If no content is received within 30 days of the deposit date, the deposit is forfeited and the project is cancelled.
Silk Lab does not guarantee specific delivery dates where delays are caused by the client, including late content submission, slow feedback, or extended periods of non-communication.
Revisions
All website and e-commerce projects include two rounds of revisions. Each revision round consists of one consolidated list of feedback submitted by the client, implemented in one pass by Silk Lab. Further revisions after two rounds are quoted as change orders.
Intellectual Property
On receipt of final payment, the client owns all custom design and code produced for their project. Silk Lab retains the right to display completed projects in its portfolio and promotional material unless the client requests otherwise in writing.
Third-party assets such as fonts, stock images, and open-source libraries remain subject to their respective licences.
Reuse of Code and Development Techniques
Silk Lab retains the right to reuse generic code patterns, components, utilities, and development frameworks across projects. Ownership of the finished deliverable does not constitute exclusive ownership of the underlying development approaches and techniques used to produce it.
Exclusivity of Client Ownership
The client does not hold exclusive rights to any code patterns, components, layouts, or development techniques used in the production of their project. Silk Lab reserves the right to apply similar approaches, structures, and solutions across other client projects. Exclusivity of ownership applies to the client's specific content, branding, and business logic only.
SEO Services
SEO services provided by Silk Lab are activity-based. Silk Lab does not guarantee specific search engine rankings, traffic levels, or any other measurable outcome. Search engine algorithms are outside the control of any developer or agency.
Limitation of Liability
Silk Lab's liability in connection with any project or service is limited to the total amount paid by the client for that project or service.
Silk Lab is not liable for any indirect, consequential, or incidental losses including but not limited to loss of business, loss of revenue, or loss of data arising from the use or inability to use a delivered project.
Website Use
The content on silklab.co.za is provided for general information only. Silk Lab makes no warranties regarding the accuracy or completeness of information on this website.
Silk Lab reserves the right to update, change, or remove content from this website at any time without notice.
Privacy
Silk Lab collects personal information submitted through contact forms and email enquiries solely for the purpose of responding to those enquiries and delivering agreed services. This information is not sold or shared with third parties.
Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or from any engagement with Silk Lab will be subject to South African law.
